Pregnancy and childbirth should be an uplifting experience, in which medical professionals play a crucial role, from prenatal care to delivery and postnatal care.

Prenatal care

Towards the start of pregnancy, the potential risks should be accurately evaluated to allocate to appropriate risk pathways for antenatal monitoring, under the care of either a midwife or obstetrician, depending on the level of risk associated with each patient’s pregnancy. Thereafter, the check-ups should be regular and any changes to the potential risks/complications that could arise should be identified and dealt with appropriately, as early as possible.

Labour and delivery

During childbirth, the medical professionals should monitor the mother and baby’s condition and provide support, pain management options and interventions if necessary. If the adequate care is provided, potential complications should be identified and dealt with appropriately to avoid premature labour, traumatic labour and stillbirths if possible.

Postpartum and newborn care

After delivery, healthcare providers should continue to support the mother with recovery and identify and treat any concerns relating to the baby as soon as possible.

Healthcare providers have a legal obligation to provide care that meets established medical standards. A claim of negligence arises when the care provided is sub-standard, which can sadly result in injuries to the mother and/or baby.

Unfortunately maternity negligence claims are not uncommon. Examples of circumstances leading to claims include:

  • Incorrect allocations to risk pathways during pregnancy
  • Failure to diagnose conditions such as preeclampsia and breech position
  • Inadequate fetal monitoring
  • Delayed responses to complications
  • Improper use of medical instruments during delivery

Medical negligence in maternity claims is a serious issue that can have lasting effects on mothers, babies and families. If you or your child have suffered an injury as a result of negligent care, you may be able to pursue a claim for compensation.

Our medical negligence team are experienced in successfully pursuing maternity and childbirth claims to obtain compensation for mothers and children. Our team understands that the devastating nature of these claims means that no amount of compensation can make up for the impacts of the negligent care; However, our team can discuss your circumstances with you with compassion and understanding, with the aim to optimise the outcome of any claim.
