Facing Allegations of Non-Accidental Injury?

We work exclusively in defending parents or carers in care proceedings who have been accused of harming their child. If your child has suffered an injury and professionals believe it was inflicted, the situation can feel overwhelming. Allegations of non-accidental injury (NAI) are among the most serious and emotionally complex challenges a parent can face. Our specialist lawyers have extensive experience defending parents and carers in care proceedings where allegations of physical abuse have been made. This includes fractures, bruising, unexplained marks, head injuries, internal injuries or even the death of an infant. Early, expert legal advice can make a crucial difference.

What Is a Non-Accidental Injury (NAI)?

A non-accidental injury refers to an injury that doctors or Children’s Services believe has been caused intentionally, through a loss of control or through negligence/recklessness. This may involve broken bones, bruises or injuries that appear inconsistent with the account given, marks or wounds that cannot easily be explained, head injuries such as brain swelling, or findings like subdural and retinal haemorrhages. When such concerns are raised, it is common for the local authority to begin care proceedings. You may also be interviewed by the police. Steps may be taken to protect the child while enquiries continue.

You do not have to face this alone — and it is vital that you seek specialist representation as soon as possible.

Our Approach to NAI Cases

We act quickly to ensure you are in the strongest legal position. We understand that there are medical conditions that can mimic signs of abuse and that accidents can have unusual consequences. We ensure that all aspects of a case are thoroughly investigated including through the instruction of independent medical experts in areas such as paediatrics, radiology, genetics and pathology to identify whether an organic or accidental cause, such as brittle bone disease, connective tissue disorders, birth trauma or low-impact falls, may explain the findings. We ensure every aspect of the evidence is tested fairly. Throughout the process, we help you present your account clearly while challenging any inaccurate assumptions or premature conclusions.

Every case is different, but our objective remains constant — to put you in the best legal position to care for your child long term.
