A recent High Court ruling has highlighted the importance of full disclosure in property transactions, the serious legal consequences of fraudulent misrepresentation, and the remedies that wronged buyers can be awarded.

A couple who purchased a £32.5 million mansion in west London successfully sued the seller after uncovering a severe moth infestation that had been concealed during pre-contract enquiries. The High Court found that the vendor, William Woodward-Fisher, had made fraudulent misrepresentations by denying knowledge of the infestation, despite pest control reports proving otherwise.  Iya Patarkatsishvili and Dr Yevhen Hunyak discovered moths throughout the property—on toothbrushes, in wine glasses, and even in their clothing, which had to be discarded. The judge ruled in their favour, awarding them a significant refund and additional damages, including stamp duty reimbursement and compensation for their ruined belongings.
