Settlement Secured by Catherine Pinnegar

Catherine Pinnegar has reached a settlement of £25,000 on behalf of a client who suffered negligent treatment from NHS staff who failed to safeguard the visually impaired client from a risk of falling.

The client was first admitted to hospital following a COVID-19 diagnosis, hallucinations, and inability to move or see clearly. Upon admission, staff failed to identify the client was suffering a stroke. In addition, the clients’ vision was not examined, despite visual impairment being one of the primary reasons for hospital admission. As a result of this, there was a subsequent failure to safeguard the client from a risk of falling.

Whilst in their extremely vulnerable state, the client fell on two occasions. After the first fall staff once again failed to safeguard the client from further risk and the client fell again. Upon falling the second time, they suffered a shoulder injury.

The settlement was a fair result given the care provided by the hospital fell below the standard of responsible medical opinion and practice, the shoulder injury specifically could and should have been avoided, and the client was relieved to be able to put the issue behind them.
