Rhoda Honey

I am an Associate Solicitor in the dispute resolution department at Wollens, specialising in property litigation and dispute resolution.

By way of background, I worked at a local law firm in their Torquay office for 10 and a half years, first as a paralegal and later qualifying as a solicitor in 2016. I spent the next 8 years building up my property litigation practice, joining Wollens in October 2024.

My particular focus is with Landlord and Tenant matters, for both commercial and residential properties. Residential matters include, but are not limited to:

  • Residential possession including Section 8 and Section 21 notices, court proceedings and enforcement;
  • Claims for rent arrears, demands and court proceedings;
  • Trespass proceedings;
  • Long lease disputes acting for either freeholder / leaseholder advising on service charge disputes, section 20 procedure and consultations, disrepair claims and breach of lease covenants;
  • Lease extensions and enfranchisement; advising on and serving notices in accordance with the statutory process, collective enfranchisement and leasehold tenant of house right to buy the freehold.

Commercial property matters include:

  • Business lease renewals; advising on and drafting notices in accordance with section 25 and section 26 of the Landlord and Tenant Act 1954;
  • Forfeiture – court proceedings and peaceable re entry;
  • Recovery of rent arrears, demands and court proceedings;
  • Dilapidations;
  • General lease advice and disputes.

Other matters include; contested adverse possession claims, easements, boundary disputes, rectification, covenants, nuisance, trespass.

Whilst there is reference to court proceedings in the above, I take a commercial view on matters and encourage, where possible, alternative dispute resolution. This can take many forms, but I have found it can be most effective through without prejudice correspondence and mediation. Court proceedings should be seen as a last resort and alternative dispute resolution a preferred option in the interest of early resolution to save clients additional time, stress and costs.

I’d like to be able to say that when I’m not advising on property disputes, that I have a busy social life. Outside the office however, I spend my time running around after my two young children and the family dog. When I do get time, I enjoy running and meals out at local restaurants.
