Negligent medical treatment can, at worst, lead to death and may give rise to an investigation by the healthcare provider into the events which occurred. Often this will involve a post mortem, and an inquest by the coroner into the cause of death. Both can be incredibly distressing to the family, but from a legal perspective can be very useful in uncovering exactly what went wrong during the patient’s treatment, and how that might have been linked to the patient’s untimely passing.

A negligence claim can be pursued independently of and as well as a claim for compensation, and will include not only an amount for the pain and suffering of the deceased, but also an award in respect of funeral and other expenses, as well as statutory bereavement damages (currently £12,980) and an award for anyone who was dependent upon the Deceased,
