Elizabeth Larner, Head of the Clinical Negligence Team at Wollens, has reached a settlement on behalf of a gentleman who had a kidney stone which was left untreated. 

The gentleman was diagnosed with a kidney stone and discharged home with the hope that the stone would disperse naturally. A few months later he was admitted to hospital and had a CT scan and ultrasound which noted the stone in his kidney which had barbarous edges, and so it was decided that he needed an urgent operation to remove it. 

However, the urgency of the referral was not noted by hospital staff, who placed him on the end of a long waiting list and, despite his GP chasing the referral, his surgery was not expedited. The hospital admitted that failing to list him for urgent surgery was a breach of their legal duty of care to him as a patient. 

As a result of the delays, before the stone could be treated, it ruptured and caused damage to his ureter.
